The Jacomo Paris Boutique, referred to hereafter as "the Site", is an electronic commerce Web site accessible
via the Internet at the following address www.jacomo.com.
The Site offers perfumery products for sale to Web surfers,
referred to hereafter as "Users", who consult the Site.
The products are offered for sale to the member states of the European Union: Austria, Belgium, Czech Republic,
Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg,
Netherlands, Poland, Portugal, Slovakia, Slovenia, Spain, Sweden and the United Kingdom.
All customers wishing to place an order have to declare that they are of age, and possess the
legal capacity to make an order or permission to do so from their parents.
It is stipulated that the products are intended for Users' personal use and have
no direct relationship with their professional activity. In this respect,
orders may not exceed the sum of €500 including VAT (not including carriage).
ARTICLE 1 – Scope of application
The general conditions herein apply without reserve or restriction to all sales of
products offered by the company Jacomo SA on the Site www.jacomo.com.
Consequently, the fact that natural persons place an order on the Site implies their full and
entire acceptance of the general conditions for sale herein. These are accessible at all
times on the Site and will prevail over any other version, should the case arise.
It is possible for Users to save or print out the general conditions for sale herein.
The general conditions for sale herein will be regularly updated. It is the Users'
responsibility to ensure that they have the most recent version.
ARTICLE 2 – Products and Prices
2.1 Products
The Products offered for sale by Jacomo are those featured on the Site
on the day the User consults it, within the limits of available stock.
The photographs illustrating the Products do not enter into the scope
of the contract.
2.2 Prices
Product prices are indicated in Euros and include the VAT applicable
on the date of the order. The prices shown on the Site do not include
packaging or delivery costs, which will be invoiced in addition, except
in the case of special offers, and will be indicated to Users when their
orders are validated.You will pay customs duties according to the weight
and the country of destination. The price in force is the one indicated on the Site, unless
there has been a typographical error
Jacomo reserves the right to change its prices at any time, including because
of variations in the price of its own suppliers
ARTICLE 3 - Orders placed on the Site
Users select the Products they wish to order on the Site according to the following procedures :
Stage 1 : Selection and addition of Products
If Users wish to place an order, they select the various Products that interest them,
and express their interest by clicking on the "Purchase" box. Each fresh addition to
their shopping basket will be indicated by the appearance of a specific screen.
At any time, Users can access a summary of the Products selected, return to their
order, modify it or terminate it.
Stage 2 : Validation of the order
To validate their orders, Users access their shopping basket. A summary of their
order then appears on the screen. If the list presented corresponds with the
Products selected, Users validate the summary.
Once Users have filled in all the information requested, they can confirm their
order by clicking on the "Confirm order" icon in order to pay.
Stage 3 : Payement
Once they have validated their payment, Users return to the Site. They have now
become "Buyers". Their orders are registered and are then irrevocable. Order forms
are registered on Jacomo's computer registers and will be considered proof of the
contractual relations created between Jacomo and customers.

Once they have validated their payment, Buyers receive an e-mail, sent to the
e-mail address indicated in the "form invoicing" section. This e-mail summarises
the order and contains an order number.
The sale will only be considered definitive once Jacomo has sent a confirmation
of the order to a Buyer, and the entire amount of the price has been collected.
The payment itself will only be considered definitive once the money has actually
been received by Jacomo SA.
ARTICLE 4 – Payment of Prices
To pay for their orders, Users make use of the means made available to them.
They click on the button indicating the payment method, and are then directed
to the electronic banking server of the bank Société Générale. It should be
noted that this is a secure server using SSL encrypting to protect all payment
method-related information as effectively as possible, and that at no time
will Users' banking details be transmitted to Jacomo's computer system.
The payment of purchases on the Site is operated exclusively in Euros using
Banker's Cards (Visa, Eurocard/Mastercard, American Express) for the entire
amount in a single transaction.
ARTICLE 5 - Delivery
The Products acquired by Buyers will be delivered within thirty (30) days
maximum to the address indicated in the order they placed on the Site.
5.1 Unavailability of Products
Products are offered within the limit of stocks available. Should any Product
be unavailable, Users will be informed :
- When the Product is selected, wherever possible. If the Product is not available,
the User will be directly informed.
- Failing this, following validation of the order, before the delivery date,
by e-mail. Jacomo will then carry out the necessary procedures with its bank to
recover the amount taken from the Buyer's account in payment for the unavailable
Product(s).
5.2 Delivery methods
Your order will be shipped by Colissimo Expert International , Colissimo Direct Suivi
for domestic orders within France, and by Colissimo Outre-Mer for orders within the
French overseas “départements” and territories, depending on the address you’ve indicated.
Jacomo SA will invoice for the packing and shipment of orders as follows :

Jacomo SA declines all responsibility in the event of excessive delay due to
the postal services, for any loss of the Products ordered or in the event of
postal strikes. It is stipulated that any transport risks are borne by the
Buyer. If delivery is delayed, Buyers should indicate the fact as soon as
possible by e-mail to the Jacomo SA customer service department at clients@jacomo.com.
Jacomo will then make contact with the postal services to set an enquiry in motion.
An enquiry of this kind may take some time.
On receipt of the Products ordered, Buyers should verify the condition and content
of the parcel. Any anomaly concerning the delivery (missing or damaged Products,
damaged package etc.) must be reported within 48 hours by the Buyer to the delivering
post office, which will issue a "damage statement". The Buyer must send this "damage
statement" without fail to the Jacomo customer service department at the following
address: Jacomo – Rue du Vertuquet – 59531 Neuville en Ferrain – France, which will
then offer to refund or re-ship the Products concerned. Failing this, the Buyer assumes
responsibility
Any Product not complying with the order, to be exchanged or refunded at the Buyer's
choice, must be returned to Jacomo SA at the following address: Jacomo SA, Avenue de
Strassburger – 14 800 Deauville, within seven (7) working days, it being understood
that the Product must be in perfect condition for resale, i.e. wrapped in its original
packaging, intact and showing no evidence of damage. In this event, Jacomo will refund
the cost of returning the item(s)
After this time limit, Products will be considered compliant and free from all
apparent defect.
ARTICLE 6 – Right to retract
Buyers have seven (7) working days to return, at their own expense, any Product(s) they
have ordered. This time limit starts on the date the order is delivered. The Products
must be returned intact and unused in their original wrapping and packaging to the
following address:
Jacomo SA, Avenue de Strassburger – 14 800 Deauville - France.
If all the above-mentioned conditions are fulfilled, Jacomo SA will refund the
Buyer within thirty (30) days the sums corresponding to the returned Products.
ARTICLE 7 - Transfer of ownership – Transfer of risks
The transfer of the ownership of Jacomo SA Products to the Buyer will only
become effective after total payment of the price by the latter, whatever
the delivery date of said Products.
However, the transfer of risks for the loss of or damage to
Jacomo SA Products will become effective as soon as the Products are
transmitted to the carrier.
ARTICLE 8 - Jacomo SA's liability - Guarantee
8.1 Jacomo SA assumes due responsibility with regard to the customer for
Products delivered in compliance with the French regulations in force, and
consequently guarantees the customer against any claim or action, whether
legal or amicable, resulting from damage caused to goods or persons through
said Products.
8.2 Jacomo SA also guarantees the customer, in compliance with the legal
regulations in force, against any latent defect affecting the Products delivered,
and which renders them unfit for use, together with any harmful consequences
thereby arising.
Jacomo SA only guarantees the customer, as regards latent defects that
may affect Products delivered, in the context of the replacement of
faulty Products or of parts rendering them unfit for use; in this case,
it may not be considered responsible by the customer for any harmful
consequences arising from a latent defect.
8.3 The Products sold on the Web Site Internet comply with the regulations
in force in France.
The customer is solely responsible for the choice of Products, and for
their preservation and use. Even if it recommended to use a perfume without
6 months of opening it, you can prolong its life by keeping it in a cool dry
place away from heat and light
8.4 Jacomo SA may not be considered responsible or at fault for any
delay or non-performance following the occurrence of a case of force
majeure as normally recognised by French case law.
ARTICLE 9 - Data protection
9.1 Personal information
In application of act no. 78-17 of 6 January 1978, it is stipulated that the personal
information requested from customers is needed for processing their orders, and is
intended for internal use by the supplier. Customers thus have the right to
access, modify, correct or delete information concerning them. They can exercise this
right by writing to:

9.2 Cookies
The Site uses 2 types of cookies. The first is a non-permanent session

ARTICLE 10 – Applicable law
All the provisions of the general conditions for sale herein,
together with all the purchasing and sale operations described,
are subject to French law. Any dispute between the parties that
cannot be settled amicably will be subject to French law.
