The Jacomo online shop known thereafter as « the Site » can be accessed by internet at the following address: www.jacomo.com.
It is edited by SARBEC laboratories, limited company with a capital of 3 000 000 Euros, registered at the Tourcoing RC under the number B 342 324 761 – head office address: Rue du Vertuquet - BP 64 - 59531 Neuville en Ferrain - France. VAT no: FR 84342324761. The Site sells cosmetics and perfumes to internet shoppers, thereafter known as « Users » who browse the Site.
Products are sold to the following countries: Germany, Belgium, Netherlands, Luxemburg, Great Britain, Italy, Spain, Austria, Denmark, Ireland and Portugal. Deliveries in France are available through the site www.Jacomo.fr

To place an order, customers must confirm that they are over 18, with the legal right to place an order or that they have parental consent.
It is stated that products are for personal use only, and with no link to customers’ professional activity. Therefore, the maximum amount of any order should not exceed 500 Euros, taxes included and delivery costs extra.

ARTICLE 2 – Products - Price

SARBEC laboratories products available for sale are those featured on the Site, on the day Users browsed the site and within stocks limits. Photographs showing products on the Site are non contractual.

Prices are given in Euros and do not include VAT rates which apply at the time of ordering. Prices on the Site do not include:
- packing and delivery costs which are invoiced extra, except in the case of special offers and will be specified to Users when they validate their orders.

ARTICLE 3 – Site orders
Users select products that they wish to order on the Site, according to the following conditions:

Then it is time for Users to identify themselves accurately by filling the form available with details of delivery address and invoicing. Once Users have completed the form, they can confirm their order by clicking on the “confirm order” button to access the payment menu.
Step 3 Payment
As soon as Users validate their payment, they go back to the Site and become “Customers”. Orders are registered and cannot be recalled. Order forms are registered on SARBEC electronic data and considered as proof of the contractual agreement having taken place between SARBEC and them. When Customers validate their payment, they receive by email, at the email address given in “My account”, a summary of their order and an order number.
Sales are only considered final after Customers have received confirmation of order by SARBEC laboratories and these have collected the full payment for it. Payment itself is only considered final after SARBEC laboratories have actually collected the funds.

ARTICLE 4 – Price payment
Users can use one of the following means available to them to pay for their orders. Users click on the payment button. Then, they are redirected to the Société Générale payment server. It is stated that the Société Générale server is subject to very advanced security in order to offer the most secured protection to all data linked to the payment process, and that, at no time, are Users bank details filtered through SARBEC laboratories computer system.
All order payments on the Site are conducted exclusively in Euros, by debit/credit cards (Visa, Eurocard/Mastercard) or by PayPal in a single transaction for the whole amount.

ARTICLE 5 - Deliveries in France (Mainland)
Products bought by Customers are delivered on average between five (5) to ten (10) days later and within fifteen (15) days maximum at the address given by them when ordering on the Site.
5.1 Out of stock products
Products are available within stocks limits. If one of the products is out of stock, Users will be notified about it. Failing this, following order validation, before delivery, via email, SARBEC laboratories promise to refund the amount paid for out of stock product(s) and deduct it from the amount taken from Users bank accounts. .
5.2 Delivery conditions
Delivery of all orders is by Colissimo expert, upon signature. SARBEC laboratories cannot be held responsible for late deliveries due to postal services and for lost deliveries or strikes. It is clearly stated that all transport risks are incurred by Customers. If a delivery is late, it is up to Customers to notify SARBEC laboratories customer services as soon as possible, by email, by clicking on the following link. Then, SARBEC laboratories will get in touch with postal services to start an enquiry.

Within seven (7) days of receiving their order, Customers must check the state and content of their parcel. If a product is not suitable, if it is not what was ordered or if is damaged, simply follow the return procedure detailed on the delivery form (included in the parcel). SARBEC laboratories promise to refund the money by bank transfer as quickly as possible.

ARTICLE 6 – Order returns
Customers have up to seven (7) working days to return product(s) ordered at their own cost. This period of time starts from the day of delivery of the order. Product(s) will need to be returned whole and unused in its (their) original conditioning and packaging to the following address:

If all stated conditions are fulfilled, SARBEC laboratories promise to refund customers within thirty (30) days, all amounts corresponding to products returned by Customers.

ARTICLE 7 – Transfer of ownership - Transfer of risk
Transfer of ownership of SARBEC laboratories products to Customers, only take place after full price payment by the latter, and this whatever the delivery date of aforementioned products.
On the other hand, transfer of risk of loss and damage to SARBEC laboratories SA products takes place as soon as they are handed over to the delivery company.

ARTICLE 8 - SARBEC laboratories liabilities- Guarantee
8.1 SARBEC laboratories assume towards clients, responsibilities accruing to products delivered in accordance to French regulations in force and consequently, guarantee them against all complains or claims, legal or amicable, resulting from damages caused to possessions as well as damages caused to persons, as a result of the aforementioned products.
8.2 SARBEC laboratories also guarantee clients, according to legal provisions, against any hidden fault affecting products delivered and rendering them unfit for use and against harmful consequences resulting from it. On account of hidden fault which could affect products delivered, SARBEC laboratories only guarantee clients within the context of replacing faulty products, or parts which could render them unfit for use, without them being considered by clients as responsible for possible harmful consequences which these hidden faults could entail.
8.3 Products featured on the Internet site are sold in accordance to European regulations currently in force. Clients are solely responsible for choosing, storing and using products. Even if it is advisable to use a cosmetic product or perfume within 6 months of opening, you can extend its shelf life by keeping it away from heat and light in a cool, dry place.
8.4 SARBEC laboratories cannot be held responsible or considered negligent for any delay or non-fulfilment following the occurrence of unforeseeable circumstances as usually defined under French jurisprudence.

In application to the law no 78-17 of 6 January1978, we would like to remind you that nominal information which clients are asked to provide is necessary for the treatment of orders and is for internal use only by the supplier.
