General terms and conditions of sale

The Jacomo Paris e-boutique, hereinafter referred to as the "Site", is a single e-commerce site accessible via the Internet at the following addresses: www.jacomo.com.

It is published by Laboratoires Sarbec SA, a public limited company with capital of 3,000,000 Euros, registered with the Tourcoing Trade and Companies Register under number B 342 324 761 and whose registered office is located at Rue du Vertuquet - 59960 Neuville en Ferrain - France. The Site offers cosmetics and perfumery products for sale to Internet users, hereinafter referred to as the "User", browsing the Site.
Products are offered for sale in the following countries: France.

To place an order, the customer declares that he/she is of legal age, has the legal capacity to place an order or has parental consent.
It is specified that the products are intended for the user's personal use, without any direct connection with the user's professional activity. In this respect, the maximum order value may not exceed 500 Euros including VAT, excluding shipping costs.

ARTICLE 1 - Scope of application

These general terms and conditions of sale apply, without restriction or reservation, to all sales of products offered by Laboratoires SARBEC on the www.corinedefarme.fr website, www.jacomo.com and www.institut-phyto.com. Consequently, the fact that an individual places an order on the Site implies full and complete acceptance of these terms and conditions of sale. They are accessible at all times on the Site and will prevail, if necessary, over any other version.
The User may save or print these general terms and conditions of sale. The present terms and conditions of sale will be updated regularly. It is the User's responsibility to ensure that he/she has the most recent version.


ARTICLE 2 - Products - Prices

2.1 Products

The products offered for sale by Laboratoires SARBEC are those shown on the Site, on the day the User consults the Site and within the limits of available stocks. 

2.2 Prices

Product prices are quoted in Euros and include VAT applicable on the date of order. The prices indicated on the Site do not include :
- packaging and delivery costs, which will be invoiced in addition, except for special offers, and will be specified to the User when the order is validated.
- any customs duties payable by the consignee.
The current price is the one indicated on the site.
SARBEC reserves the right to modify its prices at any time, in particular due to variations in its own suppliers' prices.

ARTICLE 3 - Orders on the Site

The User selects the products he wishes to order on the Site, as follows:

Step 1: Select and add products

If the User wishes to place an order, he/she chooses the various products that interest him/her and expresses his/her interest by clicking on the "Add to basket" button.
At any time, the User can access a summary of the products selected, resume, modify or complete his order.

Step 2: Order validation

To validate an order, the User accesses his/her shopping cart. A summary of the order then appears on the screen. If the list presented corresponds to the products selected, the User validates the summary.
He/she must then identify him/herself by accurately filling in the form provided, on which he/she indicates his/her exact delivery and invoicing details. They must also tick a box indicating that they have read and understood the General Terms and Conditions of Sale.
Once all the requested information has been completed by the User, he/she can confirm his/her order by clicking on the "Confirm my order" icon to pay for his/her order.

Step 3: Payment

Once payment has been confirmed, the User returns to the site and becomes a "Buyer". Their order is recorded and becomes irrevocable. The order form is recorded on SARBEC's computer registers and is considered as proof of the contractual relationship between SARBEC and the User. Once payment has been validated, the Buyer receives a summary of his/her order and an order number by email, to the email address indicated in the "my account" section.
The sale is considered final only after Laboratoires SARBEC has sent the Purchaser confirmation of the order and the Purchaser has received payment in full. Payment itself will not be considered final until Laboratoires SARBEC has actually received the funds.

ARTICLE 4 - Payment of the Price

To pay for his order, the User uses one of the means of payment available to him. He/she clicks on the payment method button. The User is then directed to the Société Générale bank's electronic payment server. It should be noted that the Société Générale bank's server is highly secure, so as to protect all payment data as effectively as possible, and that at no time do the User's bank details pass through Laboratoires SARBEC's computer system.
Payment for purchases on the site is made exclusively in Euros, by credit card (Visa, Eurocard/Mastercard) or by Paypal transfer in full and in a single instalment.


ARTICLE 5 - Delivery in France (excluding Dom Tom) and Belgium

Products purchased by the Purchaser are delivered to the address indicated by the Purchaser when ordering on the Site and according to the delivery method chosen.


5.1 Terms of delivery

- At home without signature

- Home delivery against signature

- Post office collection point

- Pick-up point in Pickup relays or Pickup Station lockers

We strongly advise you to choose one of the following delivery methods: delivery to a relay point (post office or retailer) or against signature at the location of your choice. In fact, an order delivered without signature or delivered outside a So Colissimo collection point against identification, and declared "delivered" by Colissimo, must be considered definitively lost and not eligible for compensation by their services if you have never received it. Laboratoires Sarbec cannot be held responsible, as the transfer of ownership takes place when the parcel is handed over to the Colissimo services.

Laboratoires SARBEC declines all or part of its responsibility in the event of excessive delays due to unforeseeable and insurmountable factors or force majeure.

Laboratoires SARBEC declines all responsibility in the event of non-receipt.
Upon receipt of the products ordered, the Buyer must check the condition and contents of the package. If a product is not suitable, if it does not conform to the order or if it is damaged, simply contact customer service using the form provided for this purpose on the "contact us" site or via the following e-mail address: service-clients@sarbec.com. Laboratoires SARBEC will endeavour to find a solution as quickly as possible.

If items need to be returned, a return request must be made to our services (contact form) within 14 days of delivery. After this period, no claims will be accepted.

Unfortunately we do not deliver to military addresses.

5.2 Delivery times

We guarantee that orders will be dispatched within 24 hours of order confirmation. The shipping time corresponds to the time between the validation of your order and the moment when we entrust the parcel to the carrier. Laboratoires SARBEC declines all or part of its responsibility in the event of excessive delays due to unforeseeable and insurmountable factors or force majeure.

Product delivery times correspond to delivery times and do not include the time required to process and dispatch the order. 
Delivery times vary from one sale to another and are specified at the order validation stage. 

Colissimo : average delivery time of 48 hours after Laboratoires SARBEC has given the parcel to the carrier.

5.3 Unavailability of products

Products are offered while stocks last. In the event of unavailability of a product, the User will be informed. Failing this, following validation of the order, prior to delivery, by email. Laboratoires SARBEC undertakes to refund the amount of the unavailable product(s) to the amount debited from the Purchaser's account.


ARTICLE 6 - Right of withdrawal

The Buyer has a period of seven (7) working days from receipt of the parcel to return, at his/her expense, the product(s) ordered. This period runs from the date of delivery of the order. The product(s) must be returned complete, unopened and unused in their original packaging to the following address:
Laboratoires SARBEC, Retour E-commerce, Rue du Vertuquet - 59960 Neuville en Ferrain - France.
If the above conditions are met, Laboratoires SARBEC undertakes to reimburse the Purchaser within thirty (30) days for the sums paid by the Purchaser.


ARTICLE 7 - Transfer of ownership - Transfer of risk

The transfer of ownership of Laboratoires SARBEC's products to the Buyer only occurs after full payment of the price by the latter, regardless of the date of delivery of said products.
On the other hand, the transfer of risk of loss and deterioration of Laboratoires SARBEC SA's products occurs as soon as the products are handed over to the Buyer.

ARTICLE 8 - Laboratoires SARBEC's liability - Warranty

8.1 Laboratoires SARBEC assumes responsibility towards the customer for the products delivered in accordance with current French regulations, and consequently guarantees the customer against any claim or demand, legal or amicable, resulting from damage to property or injury to persons caused by the said products.

8.2 Laboratoires SARBEC also guarantees the customer, in accordance with legal provisions, against any latent defect affecting the products delivered and rendering them unfit for use, as well as the damaging consequences resulting therefrom. Laboratoires SARBEC only warrants the customer against any latent defect affecting the products delivered, by replacing the defective products or parts rendering them unfit for use, without being held liable by the customer for any damages resulting from such latent defect.

8.3 The products sold on the website comply with the regulations in force in France. The customer is solely responsible for the choice of products, their conservation and their use. Although it is advisable to use cosmetics and perfumes within 6 months of opening, you can extend their shelf life by keeping them away from heat and light, in a cool, dry place.

ARTICLE 9 - Data protection

9.1 Personal information

In application of law no. 78-17 of January 6, 1978, customers are reminded that the personal data requested from them is required to process their order and is intended for internal use by the supplier. The customer therefore has the right to access, modify, rectify and oppose any information concerning him/her. They may exercise this right by writing to :

ARTICLE 10 - Applicable law

All clauses contained in these general terms and conditions of sale, as well as all purchase and sale transactions referred to herein, are governed by French law.
Any dispute between the parties that cannot be settled amicably will be governed by French law.
